Dr Fatih Serbest

Fatih Serbest obtained his PhD from the Dickson Poon School of Law at Kings College London studying Fast-track Arbitration under the supervision of Professor Phillip Capper. He practices public international law, international dispute resolution and international construction law. Mr. Serbest advises and represents sovereign States, international organizations and private clients on a wide range of public international law and international dispute resolution issues.
These include: the protection of international investments under bilateral investment treaties, the Energy Charter Treaty and investor-State agreements; State responsibility; State immunity; treaty interpretation; highway and infrastructure projects; and construction contracts. Mr. Serbest has advised on ad hoc and institutional international arbitration proceedings under the ICSID, UNCITRAL, ICC, LCIA and SCC Rules. He also has experience representing clients in the High Court and the Court of Appeal on questions involving public and private international law with regard to enforcement of foreign arbitral awards in Turkey. Prior to studying at the University of Essex, Mr. Serbest trained as a lawyer at the Istanbul Bar Association and worked at Gun and Engin Hukuk (law firms) in Istanbul on contentious and non-contentious commercial law matters. Mr Serbest graduated with a distinction on the LL.M. at the University of Essex and joined Kings College London in 2008. He is a member of the British Institute of International and Comparative Law, the International Law Association, the American Society of International Law, Justice and Advocates for International Development and LCIA Young International Arbitration Group Mr. Serbest’s representative matters include advising: The Government of Turkey in an ICSID arbitration brought under a bilateral investment treaty related to an electricity distribution concession.
A Turkish company in an ICSID arbitration claim against Turkmenistan under a bilateral investment treaty related to a dam construction agreement.
A major Turkish bank on sovereign debt default, sovereign immunity issues and means of recourse.
Mr. Serbest is native Turkish speaker proficient in English and speaks basic Greek.
